We have discovered that VCAT Corruption extends from the Top down, the President doesn't investigate complaints and doesn't correct Member errors, and we have Not received any response to our Urgent Injunction request And both VCAT and Director of Housing Never responded to our offer of a Site Hearing to prove our premises are Not being kept in good repair we prefer to Video record important property inspections to ensure they abide by their Duty of Care.

Beware of Member Kylea Campana 'Ms Campana'. She is hellbent on increasing her public profile as a lawyer and will publish any and all written judgements online and ferry them off to her former journalist colleagues to write stories about them. Ms Campana is irrational, impartial and will almost always side with the landlord. As state above, be careful as she will sell off her written decisions to journalists to increase her public profile.

During a hearing if you believe the presiding VCAT member is not providing you with a fairhearing or is biased you can request at the hearing that the member disqualify (Recuse) themselves under section 108 of the VCAT Act 1998, which is formally called the Reconstitution of the Tribunal, which at your request may allow you to have a different member.

In a very urgent case as a last resort applying for a Judicial Review in the Supreme Court for a Certiorari, or Mandumus, or Prohibition Order to Quash an unlawful government decision or action may be sought, be sure to request a "Protective Costs Order" in any application to Supreme Court in a Public interest case.

To avoid incompetent VCAT, under the Residential Tenancies Act Section 510, tenants can take their landlord to the Magistrates Court, County Court, or Supreme Court, (there may be large fees applicable in Supreme Court,) also see RTA sections 447 and 448 may be of assistance to you.

Theres a difference between"Public Law"and Civil Law lawyers but low economic families may qualify for Pro Bono Legal representation/advise, our family prefer to ask questions and request legal assistance etc by Email to Legal Aid.

We summoned in to VCAT two Director of Housing senior staff and one Vic. Ombudsman staff member and VCAT refused to bring them in to VCAT because they knew we had ample evidence to prove they Don't do their jobs properly, breaching Code of Conduct, and other Laws.

We requested Consumer Affairs conduct a property inspection yet there have been Four Consumer Affairs No Shows, from our experience they are part of "The Club" and incompetent.

Even though we are the Tenant Applicants, members refused to see our evidence don't allow us adequate time to convey our case, interrupt us mid sentence, have selective hearing and reading.

I am business and i believe that VCAT is biased against businesses in general when it comes to consumer cases. At my last VCAT hearing, the judge almost became the lawyer defending the client and did not have a basis for her decision. When asked for her decision in writing, she refused to give it even though i am entitled to understand the basis of her decision. So to every business out there, when VCAT issues a decision and if you do not think it is fair, then appeal or lodge a complaint with the supreme court. VCAT is there to uphold the law and provide a fair turf for businesses as well as consumers. If members have a personal bias or cannot leave their emotions out, then we have a problem that needs to be addressed.

A VCAT Member is paid in excess of $250,000 per Year to assist the Community to obtain Justice, but as they are Failing this is clearly a waste of Tax payers money. We can write a novel about the Victorian Ombudsman who also Cover up the Failings of the Director of Housing. The State of Victoria Fails to protect the vulnerable and disadvantaged against Public Sector Misconduct.

If the member refuses to recuse themselves ask that the member place in the VCAT order their "Written reasons" for refusing your reasonable request, this may help if you decide to appeal any VCAT decision.

In Two Tenants Applications to VCAT within six years we have taken the Director of Housing to VCAT for Failing to keep our premises in good repair and Director of Housing Maladministration.

VCAT is a Corrupt forum which Fails to provide natural justice or fair hearings from our Family's experience in the Residential Tenancies List.

Might as well bring a plastic bag because they'll probably assume your bag is a weapon too. Although be better for the environment if you brought a green bag! :)

Everything is a weapon.... Stole my fork and had a negative experience with the security as he made it such a big deal to get the paperwork out.

Try and get a Solicitor of your own choice in VCAT and Court.

Also VCAT Registrars try to keep our submissions out of our File, wrongly open another file for the same case to dilute and confuse the case, use wrong VCAT file number in correspondence, VCAT dont list all of the Director of Housing breaches that we the Tenant Applicants have mentioned.

VCAT's only objective is to cover up the serious misconduct of government departments such as the Director of Housing (repeat offender.)

I thought the verdict was fair overall and I quite enjoyed the process even though I was a little nervous at first. System went by the way of neutralizing the situation rather than fighting for a win lose which is interesting. I would use VCAT again.

VCAT takes advantage that many people aren't fully aware of their Human rights. Please note that VCAT and other Public authorities must make decisions compatible with the Victorian Charter of Human Rights and Responsibilities Act 2006 Sections 8, 17, 24, 38, 39 may assist.
